1. Agency Relationship & Scope of Services

Cruising Along LLC ("Agency," "we," "us," or "Advisor") operates as an independent contractor affiliated with host agency WorldVia Travel Group. We act solely as a booking intermediary and sales agent for third-party travel suppliers (including, but not limited to, cruise lines, airlines, tour operators, ground transportation companies, hoteliers, and travel protection insurers; collectively, "Travel Suppliers").

We do not own, manage, operate, or control any aircraft, cruise vessel, motorcoach, hotel, or other travel provider. By engaging our services, requesting quotes, or authorizing travel reservations through our website, email, phone, or messaging platforms, you ("Client," "you," or "your") agree to be bound by these Terms & Conditions.

2. Pricing, Direct Supplier Payments & Agency Compensation

  • Direct Supplier Billing: Cruising Along LLC does not collect, hold, or escrow client travel funds. All payments for deposits, balances, excursions, and travel insurance are billed and charged directly by the respective Travel Supplier using the credit or debit card details authorized by you.
  • Payment Authorization: Providing your billing information constitutes an express authorization for Cruising Along LLC to submit your payment details directly to the Travel Supplier solely for the booking(s) approved by you.
  • Deadlines & Cancellations: Deposit amounts, interim payment schedules, and final payment deadlines are established entirely by the individual Travel Suppliers. Cruising Along LLC is not responsible for supplier-initiated cancellations, penalties, or lost inventory resulting from card declines, processing delays, or missed deadlines.
  • Price Adjustments: Quoted rates are subject to supplier availability, fuel surcharges, government taxes, and foreign exchange fluctuations until the reservation is confirmed and paid in accordance with supplier terms.
  • No Direct Agency Fees / Supplier Commission: Cruising Along LLC does not charge direct booking, advisory, or planning fees to the Client for standard travel arrangements. Our agency is compensated via commissions paid directly by Travel Suppliers upon completion of travel.

3. Cancellations, Modifications, and Supplier Terms

  • Supplier Policies Govern: Every travel reservation is governed by the specific contract of carriage, ticket contract, terms, conditions, cancellation penalty schedules, and refund policies of the applicable Travel Supplier.
  • Refunds and Credits: Cruising Along LLC does not determine refund eligibility, process refunds from its own accounts, or issue cash returns for canceled travel. Any available refund, future credit, or voucher is issued solely at the discretion and timing of the Travel Supplier.
  • Voluntary Changes: Client-requested changes to itineraries, cabin categories, flight segments, or passenger details are subject to supplier availability and any supplier-imposed change penalties or fare adjustments.

4. Travel Insurance & Trip Protection

Travel insurance is strongly recommended to protect against unforeseen circumstances, including medical emergencies, trip cancellation or interruption, missed connections, mechanical disruptions, supplier insolvencies, lost luggage, and emergency medical evacuations.

Cruising Along LLC can provide options for third-party travel protection policies. It is your sole responsibility to review policy details, coverage limits, exclusions (including pre-existing condition waivers), and claims requirements. If you choose to decline travel insurance, you acknowledge that you bear full financial responsibility for any cancellation penalties, delays, or out-of-pocket medical expenses.

5. Travel Documentation & Client Responsibilities

  • Passports & Visas: You are solely responsible for obtaining and verifying all required travel credentials, including passports (which generally must be valid for at least six (6) months beyond your return date), travel visas, electronic travel authorizations, and vaccination records required by destination authorities.
  • Accuracy of Traveler Details: You must ensure that all passenger names, dates of birth, and contact information provided to Cruising Along LLC match your government-issued identification or passport verbatim. Cruising Along LLC is not liable for denied boarding, re-ticketing expenses, or entry refusals resulting from incorrect information provided by the Client.
  • Health and Safety Guidelines: You are responsible for consulting official destination guidelines, including advisories issued by the U.S. Department of State and the Centers for Disease Control and Prevention (CDC), and ensuring compliance with all boarding and destination health protocols.

6. Limitation of Liability & Force Majeure

  • Third-Party Acts: Cruising Along LLC assumes no liability, responsibility, or financial obligation for any personal injury, illness, property damage, loss, accident, delay, itinerary change, or default resulting from the acts, errors, or omissions of any Travel Supplier, transportation carrier, or third party.
  • Force Majeure: Cruising Along LLC is not liable for travel disruptions, delays, cancellations, or damages resulting from events beyond reasonable control ("Force Majeure"), including acts of God, severe weather, hurricanes, maritime diversions, public health crises, strikes, labor disputes, civil commotion, war, or government actions.
  • Cap on Damages: To the maximum extent permitted by applicable law, the cumulative, total liability of Cruising Along LLC for any and all claims, disputes, or causes of action arising out of or related to our services—regardless of the legal theory—shall be strictly limited to the total commission amount actually received by Cruising Along LLC from the Travel Supplier for the specific booking at issue, or $100.00 USD, whichever is less. In no event shall Cruising Along LLC be liable for any indirect, incidental, consequential, special, or punitive damages.

7. Governing Law, Jurisdiction & Class Action Waiver

  • Florida Law: These Terms & Conditions are governed by and construed under the laws of the State of Florida, without giving effect to conflict of laws principles.
  • Exclusive Venue: Any legal action, proceeding, or small-claims filing arising out of or relating to these Terms must be filed and maintained exclusively in the appropriate state court located in Orange County, Florida.
  • Class Action Waiver: All claims must be brought on an individual basis. You expressly waive any right to initiate, join, or participate as a plaintiff or class member in any class, collective, or representative proceeding against Cruising Along LLC.

8. Seller of Travel & Agency Disclosures

Cruising Along LLC is an independent contractor affiliate of host agency WorldVia Travel Group (WorldVia Travel Network).

  • Florida Seller of Travel Registration: Cruising Along LLC operates under the Florida Seller of Travel registration of WorldVia Travel Network (ST# ST36257).
  • Florida Independent Agent Number: TI123427
  • State Registration Disclosures: Cruising Along LLC is registered to sell travel to residents in 47 states. Cruising Along LLC is not currently registered to sell travel to residents of Washington, Hawaii, or California and cannot accept bookings from clients residing in these states.
